New York requires mandatory state licensure for behavior analysts under Article 167 of Education Law. Two pathways available: (1) Standard pathway requiring master's degree from NY-registered ABA program, supervised experience, and examination; (2) BACB pathway (since Nov 22, 2022) for BCBA holders. License is granted for life but triennial registration required to practice. No state-mandated continuing education - follow BACB requirements for certification maintenance.

Detailed Requirements

Education Requirements

LBA: Master's or higher degree from applied behavior analysis program registered by the Department or determined equivalent. CBAA: Bachelor's degree or higher. BACB Pathway: Hold BCBA certification from BACB.

Standard pathway: Experience in applied behavior analysis practice satisfactory to Board and Department. BACB pathway: Experience already verified through BACB certification process.

Standard pathway: Examination acceptable to Board and Department. BACB pathway: BACB exam completion verified through certification. Additional: Must complete Child Abuse and Maltreatment identification training.

Triennial (3-year) registration required to practice. License itself is granted for life and does not expire. No state-mandated continuing education requirements. Must maintain active registration status - lapsed registrations marked 'NOT REGISTERED'. BACB certification holders should maintain their national certification separately.

LBA: $200 initial license + $100 first registration = $300 total initial. $100 triennial registration renewal. CBAA: $150 initial + $75 first registration = $225 total. $75 triennial renewal. Limited Permit: $70 initial and renewal. Graduate Permit: $10 (non-refundable).

Two pathways exist. Standard pathway does not require BACB certification. BACB Pathway (effective November 22, 2022) allows BCBA holders to apply for LBA license based on national certification. BACB certification alone is not sufficient to practice - must still obtain state license. Maintaining BACB certification separately recommended for those using that pathway.

New York is unique: license is granted for LIFE with no state-mandated CE requirements - only triennial registration needed to practice. Must be at least 21 years old. Good moral character required. Child Abuse and Maltreatment training mandatory. LBAs cannot supervise more than 6 CBAAs. Must provide annual status reports to prescribing healthcare providers. Cannot prescribe drugs or use invasive procedures. Graduate permits available for those completing supervised experience (valid 3 years, $10). Limited permits available ($70, 1 year, renewable once).

November 22, 2022: Education Law amended to add BACB certification pathway for LBA licensure. This allows BCBA holders to apply for NY LBA license without separate examination. 2023: Supervised experience regulations updated (Section 79-17.2) - prohibition on paying supervisors for supervision.

Additional Information

New York's LBA license is unique nationally - it's granted for LIFE with no state-mandated continuing education requirements. Only triennial registration is required to practice. The November 2022 BACB pathway addition was significant - it allows BCBA holders to obtain NY licensure more easily. LBAs are classified as healthcare professionals treating autism and related disorders. Notable restriction: cannot supervise more than 6 CBAAs. Graduate permits ($10) allow practice while completing fieldwork.
